Kpandai MP Matthew Nyindam Files Appeal, Seeks Stay of Execution Against Court-Ordered Election Rerun

Incumbent Member of Parliament for Kpandai, Matthew Nyindam, has filed a notice of appeal along with an application for a stay of execution following a ruling by the High Court in Tamale ordering a rerun of the parliamentary election in the constituency.

The High Court, in its decision, mandated that a fresh election be conducted within 30 days, citing procedural irregularities at the collation centre during the original vote. The ruling was delivered in favour of the National Democratic Congress (NDC) parliamentary candidate, Daniel Nsala Wakpal, who argued that breaches in electoral processes impeded his right to fully participate in the collation.

By filing the appeal and the stay of execution, Mr. Nyindam aims to challenge the court’s verdict and suspend the enforcement of the rerun until the appellate court reaches a decision.

Speaking on Channel One TV on Monday, November 24, Haruna Mohammed, Deputy General Secretary of the New Patriotic Party (NPP), defended the decision to pursue the stay, alleging significant irregularities in the High Court proceedings.

“Before the proceedings began, I was there along with the other lawyers. Immediately the computer was opened, the judgment was already there. I was surprised because we had not even argued the case in court. What we saw outside was all the bigwigs of the NDC jubilating before the judgment came out,” he said.

Mr. Mohammed further questioned the basis for ordering a full constituency rerun, noting that the dispute involved only 41 of the 152 polling stations.

“All the pink sheets had been signed by all party agents, and there were no issues with the remaining polling stations aside from the 41. If anything, the rerun should only cover those polling stations,” he argued.

He confirmed that the notice of appeal and the stay of execution application were filed at 10:04 a.m., immediately after the court delivered its ruling.

The appeals process is expected to trigger further legal exchanges between the parties, potentially delaying the scheduled rerun. Meanwhile, political tensions in Kpandai remain high, as both the NPP and NDC closely monitor the unfolding developments that could influence the constituency’s representation in Parliament.
